1. Agreement to Terms & Owner Authority

By accessing, browsing, submitting a URL or @handle, or making any payment on boost.app ("Platform", "we", "us", or "our"), you explicitly agree to be legally bound by these Terms of Service. The platform owner reserves the right to modify these terms at any time without prior notice. Continued use of the platform constitutes full acceptance of updated terms.

2. Absolute No-Refunds & Anti-Chargeback Policy

  • All Sales Are Final & Non-Refundable: Every transaction processed on boost.app is for digital advertising placement that is fulfilled instantly upon payment completion. Under no circumstances — including competitor outbidding, position drop, buyer remorse, server downtime, or platform updates — will any payment be refunded.
  • Dynamic Outbidding Notice: You acknowledge and agree that your rank placement is dynamic and competitive. Other users may outbid your position at any moment. Being outbids by another user is an intended core feature of the platform and does NOT qualify for a refund.
  • Payment Dispute Waiver: By completing a payment via Dodo Payments or credit card, you waive any right to file a dispute, claim, or chargeback. Any unauthorized or fraudulent chargeback claim filed through payment processors will be vigorously contested using stored IP addresses, transaction audit receipts, and server access logs.

3. Owner Right to Remove & Terminate Listings

The platform owner retains absolute, sole discretion to edit, modify, suspend, or permanently remove any submitted listing, domain, or handle without refund if:

  • The URL links to malware, spyware, scams, or deceptive practices
  • The content includes adult, pornographic, or illegal material
  • The link is a group chat or invite shortener (Telegram, Discord, WhatsApp, bit.ly, etc.)
  • The link or handle infringes on third-party trademark rights or violates public decency
  • The platform owner determines, in their sole opinion, that the listing damages the reputation of boost.app

4. Complete Disclaimer of Warranties & No Traffic Guarantee

The Platform is provided strictly on an "AS IS" and "AS AVAILABLE" basis. We make zero express or implied warranties regarding uptime, traffic volume, user clicks, conversion rates, search engine rankings, or business revenue resulting from your listing placement. You assume 100% risk for all marketing performance.

5. Total Limitation of Liability & Hold Harmless Agreement

Under no circumstances shall the platform owner, developers, or affiliates be held liable for any damages of any kind.

In no event shall boost.app or its creator be liable for any direct, indirect, incidental, punitive, or consequential damages (including loss of profits, data, reputation, or business opportunity) arising out of your use of the platform. You are using this service entirely at your own, sole risk. The platform owner’s maximum aggregate liability to you for any claims shall not exceed the amount you paid to the platform in the last 12 months, or $1.00 USD, whichever is lower.

Indemnification & Hold Harmless: You agree to fully defend, indemnify, and hold harmless boost.app and its owner against any and all third-party claims, lawsuits, liabilities, losses, damages, or legal fees resulting from your submitted URLs, branding, or violation of these terms. You agree that no legal action can be taken against the platform owner for any reason.

6. Class Action Waiver & Binding Arbitration

No Class Actions: You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action. You explicitly waive any right to bring a class action lawsuit against the platform or its owner.

Arbitration: Any disputes that cannot be resolved informally shall be resolved exclusively through binding arbitration rather than in court. You agree that by using this platform, you waive your right to a trial by jury or to participate in any legal lawsuit against boost.app.

7. Governing Law & Absolute Jurisdiction

These Terms shall be governed by and construed in accordance with applicable governing laws of the platform owner's jurisdiction, without regard to conflict of law principles. Any legal action or proceeding related to this platform shall be brought exclusively in competent courts having jurisdiction over the platform owner.
